In no event will the SA Travel and Tourism cc, or any person or entity involved in creating, producing or distributing Site or the Site software, is liable for any damages, including, without limitation, direct, indirect, incidental, special, and consequential or punitive damages arising out of the use of or inability to use Site. Subscriber hereby acknowledges that the provisions of this section shall apply to all content on the Site.
The Subscriber agrees to defend, indemnify and hold SA Travel and Tourism cc, its officers, employees, agents, licensors and suppliers, harmless from and against any claim, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the content (including Software), or the interactive areas in a manner that violates or is alleged to violate these terms and conditions.
The Subscriber expressly agree that exclusive jurisdiction for any dispute with the Site, resides in the courts of Durban and the Subscriber further agrees and expressly consents to the exercise of jurisdiction in the courts of Durban in connection any such dispute including any claim involving SA Travel and Tourism cc or it affiliates, subsidiaries, employees, contractors, officers, direct telecommunication providers and content providers.
The Subscriber also expressly agrees that notice given to SA Travel and Tourism cc will be by registered post. Notices to SA Travel and Tourism cc by conventional mail must be sent to SA Travel and Tourism cc, P.O. Box 1944, Verulam, 4340, Kwa Zulu Natal - SA. In any matter requiring SA Travel and Tourism cc’s prior consent, such consent will be considered given only if sent by conventional mail and signed by an authorised representative of SA Travel and Tourism cc
